1、 Trademark Overview

The Chinese Trademark Law follows the principle of first application. The principle of first application means that where two or more applicants apply for registration of the same or similar trademarks for the same or similar goods, the Trademark Office accepts the first trademark registration application and rejects the later trademark registration application.

3、 Registration process

Trademark conception - trademark inquiry - trademark application - formal examination - substantive examination - trademark announcement - trademark licensing

1. Trademark name and logo design: trademark conception or design, as the logo of an enterprise, represents the external image of the enterprise, contains rich enterprise connotation, and generally has a strong significance.

2. Trademark inquiry: At present, there is no official inquiry institution for trademark registration in China, which is generally through an agency. There is a blank period of six months for Chinese trademark inquiry. There may be no way to find the trademarks within six months before the date of inquiry. Trademark query mainly queries whether there are similar trademarks applied earlier. Therefore, the ability of trademark searchers to accurately judge whether trademarks are similar is particularly demanding.

3. Trademark application: the trademark agency shall act on behalf of the trademark agency. The trademark agency shall be familiar with the process and forms of trademark application and be able to fill in the forms according to the requirements specified by the Trademark Office to ensure that it can pass the examination in the form of the Trademark Office at one time.

4. Trademark form examination: whether the main application trademark application materials meet the basic requirements of the application. If not, the Trademark Office requires to supplement and correct the materials. If the non professional agency fails to complete the materials at one time, it will increase the process of correction, which will extend the time for trademark application for at least one and a half months.

5. Trademark substantive examination: It refers to the examination of the trademark applied for by various departments of the Trademark Office. Generally, there are various factors such as legality, similarity, distinctiveness, etc. If one of them does not meet the requirements, it will be rejected. The rejection can be reviewed. The rejection of review is mainly a defense against the rejection of the Trademark Office. If the review is successful, the next procedure can be started. If it is unsuccessful, the trademark registration will become invalid.

6. Trademark announcement: it means that the trademark will be announced 3 months before the registration is allowed to pass the substantive examination to see if anyone has any objection to the registration of the trademark. If any objection is raised, the Trademark Office will notify the agency. After receiving the notice of objection, the objection can be reviewed. If the review is passed, the trademark can be registered. If the review is not passed or not conducted, the trademark registration will become invalid.
